Terms & Conditions

You should read these terms and conditions carefully before buying from us, and we recommend you keep a copy for your own reference. This website, its terms and conditions and all contracts placed are governed by and constructed in accordance with English law.

2. HOW TO PLACE AN ORDER

2.1. To place an order:

Carefully select the item you require and add the quantity you wish to purchase in the buy box for that item.

Once all the items you require have been selected proceed to checkout where you will be required to enter a postcode for UK residents or select a country for residents outside the UK (Please note: channel island residents must select the latter option)

Follow the on screen instructions to complete order.

2.2. By placing an order you are offering to buy goods from us at the stated price subject to these terms and conditions. We will let you know that we have received your order by email but this does not mean that your order has been accepted. There is no contract between us until we have accepted your order.

2.3. When we have accepted your order, we will confirm this in an email. Keep your confirmation in a safe place in case of any query.

2.4. If we cannot supply you with the goods you have ordered, we reserve the right to supply you with substitute goods of similar quality and function. If we supply you with substitute goods, you do not have to keep them and we will collect them at our cost if they are not acceptable.

2.5. Credit card payments are handled through a secure 128Bit encrypted site. All Payment details will be kept secure and will not be revealed to any third party, except as may be necessary in order for us to receive payment in accordance with your instructions.

2.6. Any details you enter into our website may be stored by us for the sole purpose of processing your order. These details will remain confidential and will NEVER be issued to any third parties. Only if you sign up for our newsletter may we use your details to send you special offers or new product information, but again your details will remain confidential and will NEVER be issued to any third parties.

2.7. We reserve the right to refuse to accept any order without giving reason. Anybody placing an order for goods must be aged 18 or over.

2.8. Images may not show the actual size of items, all measurements are approximate and are indicative only.

2.9. Title of Goods: All goods remain the property of Avon Automotive Diagnostics Ltd until paid for in full.

3. DELIVERY

3.1. We use Courier and Royal Mail for delivery of goods. Courier and some Royal Mail deliveries require a signature upon delivery as proof of delivery. You may request a special delivery instruction, however any goods left unattended or without your signature is at your risk and we cannot accept responsibility for any loss or damage. Deliveries are normally made between 8.30am - 5.00pm Monday - Friday.

3.2.
New Service: 1st Class Not Recorded for orders between £1 and £110: If this service is selected, the order will be sent via Royal Mail 1st class post, but as it is not a Recorded service, we can accept no responsibility if the goods are not delivered or are late.

 

3.3. Please inspect your delivery and report any goods found to be damaged or faulty as soon as possible.

3.4. Please allow 7 working days for delivery (from the date of placing your order) before reporting your order as undelivered. Most items are available for delivery within 7 days of your order. If we are unable to supply you with your goods within this time, we will aim to contact you to let you know and give you a revised delivery date. You will be given the option to cancel or amend your order if this is the case.

3.5. If we fail to supply you, or supply you with goods that you find to be damaged, faulty or misdescribed after a reasonable examination, we will replace the item free of charge or refund your money. In these circumstances we reserve the right to ask you for independent confirmation of any claimed faults.

4. YOUR RIGHTS WHERE GOODS ARE NOT SATISFACTORY QUALITY, FIT FOR THEIR PURPOSE OR MISDESCRIBED

4.1. Repair or replacement

4.1.1. Unless they have faults reported to us as a result of your initial examination of the goods (see 3.2), we will repair any goods that are faulty, unsatisfactory or unfit for their purpose (see 4.1.2), or offer you a like-for-like replacement (see 4.1.3). If we supplied you with the goods more than six months ago, we reserve the right to ask you to prove that the goods were faulty when we supplied them to you.

4.1.2. If we offer you a repair, and a repair is not possible or not possible within a reasonable period of time, we will offer you a refund equivalent to the replacement cost of the item, taking into consideration its age and any fault-free use you have had from it.

4.1.3. If we offer you a replacement and a like-for-like replacement is not available, or not available within a reasonable period of time, we will offer you a refund equivalent to the replacement cost of the item, taking into consideration its age and the fault-free use you have had from it.

4.1.4. Any additional costs associated with repair or replacement of faulty goods will be borne by us. This will include the cost of return delivery of the item to us or to a mutually acceptable third party repairer (see 4.1.6).

4.1.5. Replacements and refunds will be on a like-for-like basis. This means you may not receive a new item as replacement or a full refund if you have had the goods for a while or if you have had a reasonable period of fault free use from them.

4.1.6. We reserve the right to ask for independent third party confirmation of any faults. If this is necessary, we will initially bear the costs but may ask you to reimburse us if the goods are found to be satisfactory. We shall inform you that we intend to seek confirmation of the claimed faults before we do so and who we will be approaching to do this. You may suggest alternative independent third party.

4.1.7. Goods with faults due to normal wear and tear or damage caused by misuse will not be repaired or replaced free of charge.

4.2. Refunds

4.2.1. Full refunds will be given as a result of claims under Section 3.4. All other refunds will be based on the replacement cost of the goods. This means you may not receive all the money you paid.

4.2.2. Money will be refunded to the same account debited during purchase. All refunds and partial refunds will be completed within 30 days.

5. YOUR RIGHTS UNDER THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS (DSR)

5.1. You have an unconditional right to cancel your order within seven working days from the day of delivery. PLEASE NOTE: You must take reasonable care of the goods during the cancellation period.

5.1.1. To cancel your order under the DSR:

Send an email, phone or write to us telling us you wish to cancel the order. Include enough information for us to identify you and your order.

Parcel up the items you are returning securely to minimise any damage that may be caused during delivery. Please include a copy of your notification of cancellation or order confirmation so we can trace your order quickly.

Return the items to us via an appropriate carrier. PLEASE NOTE that returning goods under the cooling-off period allowed by the Distance Selling Regulations is at your cost unless we have supplied alternative goods that you have not found acceptable.

5.1.2. Once you have notified us of your intention to cancel the contract we will refund you the cost of your order as soon as we can. This will always be within 30 days of your cancellation and return to us of the goods.

5.2. This section does not affect your legal rights as outlined in sections 3 and 4

6. OUR RETURNS POLICY

6.1. This section does not affect your statutory rights relating to faulty or misdescribed goods (section 4) or your right to cancel orders under the DSR (section 5). If you want more information on these rights, they are available from your local Trading Standards Department or Citizens Advice Bureau.

6.2. For returns after 7 days please contact us by email, phone or letter to request the return of an item. Any agreed goods returned must as new, unused and returned securely at your cost. Goods will then be refunded to the original method of payment within 30 days of receipt to us of goods.

7. PRICING

7.1. All prices quoted are in pounds sterling and are shown inclusive and exclusive of VAT. Delivery will be at the rate indicated.

7.2. From time to time we will have to change the prices of items. This will not affect the status of confirmed orders and in this case you will only pay the price contained in your order confirmation. If the price of an unconfirmed order changes, we will let you know and give you the option of cancelling the order.

8. LIMITATION OF LIABILITY

8.1. In the event of faulty goods having been supplied, or any other failure, however caused, of these goods, our maximum liability will be limited to the value of those goods.

8.2. In particular, we will not be held liable for:

 

8.2.1. the cost of vehicle recovery,

8.2.2. the cost of rental of alternative vehicles,

8.2.3. any loss of profits, savings, business or goodwill, whether actual or anticipated, even if we had been previously advised by you that such losses may occur.

 

9. FITNESS FOR PURPOSE

 

9.1. You acknowledge and agree that you have relied on your own judgement when selecting the goods. The goods sold on this website are sold to trade account holders.

 

10. PRIVACY POLICY 

 

10.1. We are committed to responsible data management and subscribe to the principals of the data protection legislation in the United Kingdom. We are committed to maintaining the privacy of our users and maintaining the security of any personal information received from you. If you register for any of the Services you will be asked to provide basic personal information. The information provided by you is not available for sale or use by third parties. The information is used solely for notifying you of changes or updates to the Website/Services. 

 

10.2. We use a technology called "cookies" as part of our normal business procedure to track patterns of behaviour of visitors to the Website. A cookie is an element of data that the Website sends to your browser that is then stored on your system. You can set your browser to prevent this happening. Any information collected in this way can be used to identify you unless you change your browser settings.

 

11. ABOUT THESE TERMS

11.1. These terms came into force on the 08/11/10 (Issue number 2) and apply to all orders made after 17.00hrs on that day.

11.2. These terms and conditions may be amended at any time at our sole discretion without notice. However the terms and conditions at the point of order will always apply.
